A father is established as the legal father of a child born out of marriage when he signs an acknowledgement of paternity or is determined to be the legal father by way of an Order of Filiation. If paternity has not been established, either party can file to establish paternity. If one party is not certain about the paternity, a DNA or genetic marker test may be ordered.
If paternity is established, the Court can proceed into child support.
